Terms of Service

By accessing or using the MyRestoSmart platform ("the Platform"), you agree to comply with these Terms of Service. If you do not accept them, please do not use the Platform.

These terms apply to all visitors, users and businesses registered on MyRestoSmart. The Platform reserves the right to change these terms at any time, with prior notice.

MyRestoSmart is a SaaS (Software as a Service) platform for food businesses. It provides:

• A professional website for the business (a custom subdomain)
• A digital menu system with a QR code
• An admin panel for managing the business
• A WhatsApp ordering system (depending on the plan)
• An online reservation system (depending on the plan)
• Analytics and visit statistics
• A listing in the public MyRestoSmart directory

To use the Platform as a business, you must:

• Complete the registration form with accurate and truthful information
• Be the owner or legally authorized to represent the business
• Keep your login credentials confidential
• Notify MyRestoSmart immediately if you suspect unauthorized access

MyRestoSmart reserves the right to refuse or suspend any registration that violates these terms or applicable law.

A MyRestoSmart subscription is billed annually according to the chosen plan — Starter, Business or Premium. The full current prices are always kept up to date on the Pricing page.

Payment is made in advance for the whole year. The subscription renews automatically each year unless it is cancelled 30 days before expiry.

After this 30-day period, no refunds are offered for the remaining part of the paid year. The business may continue using the platform until the end of the paid period.

For refunds or complaints, contact support@myrestosmart.com within the guarantee period.

As a registered business, you agree to:

• Publish only accurate and truthful information about your business
• Not use the Platform for unlawful or fraudulent activity
• Not upload content that infringes the copyright of third parties
• Comply with applicable consumer protection laws
• Not share your account credentials with third parties
• Notify MyRestoSmart of significant business changes (closure, change of owner, etc.)

Violating these obligations may result in suspension or deletion of the account, without a refund.

The MyRestoSmart platform — the source code, design, logo and trademarks — is the exclusive property of MyRestoSmart and is protected by intellectual property law.

Businesses retain all rights to their own content (logo, photos, menu, descriptions). By uploading content to the Platform, you grant MyRestoSmart a limited licence to display that content for the purposes of the service.

MyRestoSmart is not liable for:

• Service interruptions caused by factors beyond our control (force majeure, internet infrastructure problems)
• Data loss caused by the business's own actions
• Indirect or incidental damages arising from use of the Platform
• The accuracy of information published by third-party businesses

MyRestoSmart's total liability to any business will not exceed the amount paid for the subscription during the last 12 months.

MyRestoSmart reserves the right to change these Terms of Service at any time. Changes take effect 30 days after businesses are notified by email.

Continued use of the Platform after notification is considered acceptance of the new terms. If you do not agree with the changes, you may cancel your subscription without penalty during the 30-day notice period.

These Terms of Service are governed by the applicable law of the jurisdiction in which MyRestoSmart operates. Any dispute arising from or relating to these terms will be resolved by the competent courts of that jurisdiction.

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
